Legal Forms that Apply to Bodily Injury Litigation.

There are a number of legal forms that apply to the injuries themselves, not to the cause of the bodily injuries. We have grouped these legal forms into this suite of personal injury litigation forms.

But let's get back to informing you about the several bodily injury forms in this BI Suite portion of our catalog.  The first legal form to discuss is the most basic.  Every defense attorney in a motor vehicle, premises liability, or product defect case -- any tort BI case --- will want Plaintiff's Bodily Injury Deposition or Testimony Checklist.  It is a complete checklist for the bodily injuries portions of your questions outline for the deposition of an injured person in any type of tort personal injury case.

Likewise, every plaintiff's attorney will want Plaintiff's Bodily Injury Deposition or Testimony Checklist, but for two different reasons than the defense wants this form.  As the lawyer for the injured person you will use this this checklist to prepare your personal injury lawsuit client for his/her deposition by the defense.  And you will use this as your guide as your outline for asking your client questions at trial, to get the best direct testimony about the injuries into evidence. The form comes in two different styles, but with the same objective: giving you an outline checklist of questions regarding the bodily injuries to the plaintiff. When it came to the trial, for the first five years doing defense work, I never could understand why most plaintiff's attorneys never had their client spend much  much time on the witness stand telling the real details of the injury that mean so much to the jury.  When I started doing more plaintiff's work than defense work, I realized why:

And, on the other side of the table, most defense attorneys never took the time to develop a complete checklist of the injury questions to ask the plaintiff at the deposition.

The Plaintiff's Bodily Injury Deposition or Testimony Checklist is for use with the injured person, is the more powerful form, is designed for both plaintiffs and defendants, useful in both depositions and trials, and is, quite frankly, may be the most expensive form we have on a dollar per page basis.  Yet, like all our forms, if it saves you a half-hour of time - ever - it pays for itself.

The Spouse's form is primarily just for plaintiff's counsel's trial use.  But as a defense attorney for over 35 insurers and national self-insured companies, in five states, I always used this form when taking the deposition of the spouse.  I found that if the plaintiff's attorney had not prepared the client sufficiently, I would uncover some good testimony to minimize damages at the trial.  By going through the list of items, I would always come up with several items I could safely ask at trial and get answers on a number of things that the spouse had told me at trial had not been affected by the injuries.  End a cross-exam at trial with 10 of those in quick succession and the plaintiff loses a lot ground with the jury.
